The trial of Peter Milius, the former Lafayette College student facing invasion of privacy and child pornography charges, will begin on April 28.
Milius, who was released on unsecured bail and is not currently living in the Easton area, appeared in criminal court before Northampton County Court of Common Pleas Judge Michael J. Koury Jr. during a Tuesday morning legal proceeding.
His defense attorney, Gary Asteak of Easton-based Asteak Law Office, stood before Koury Jr. alongside Milius, and chose the earlier of two trial dates offered. There are still opportunities for the case to be settled before then.
The trial, if proceeded as scheduled, will occur over 17 months after the inciting incident and one year after Milius was arraigned. Legal proceedings took place last September and November — according to court documents — though the trial date that was originally scheduled was delayed. Asteak said it is normal for cases to last this long.
“Right now, like many cases, it is just moving through the court system, moving slowly,” Asteak said of Tuesday’s proceedings. “But it’s moving slowly because it’s an important case.”
A waiver of the right to a speedy trial and an application for continuance were filed on Nov. 25, according to court documents.
Millius is not eligible for Accelerated Rehabilitative Disposition — a Pennsylvania court program typically available to first-time offenders — due to the nature of the case, according to Asteak.
If convicted, Milius will be added to the sex offender registry. Milius is facing two counts of misdemeanor invasion of privacy without consent and an unrelated felony count of possession of child pornography.
Anna Thompson, the Northampton County public relations administrator, recommended checking the docket system for any updates before the April trial.
The defense does not plan to file any additional motions ahead of April’s trial, according to Asteak.
