Mindleaf CBD, a hemp store previously operating on Cattell Street, has now closed as a result of the search on July 31 that found marijuana and other products outlawed in Pennsylvania. The building sits empty as three of Mindleaf’s co-owners, David and Susanne Allocca and Dawn Williams, await trial.
According to Gary Asteak, the Alloccas’ attorney, the defense is currently securing information about the laboratory testing of the seized items before the trial can occur. The testing would determine whether the THC level in the products sold would be considered marijuana as defined by Pennsylvania law, impacting the legality of the search as well as the items sold. The trial depends on whether marijuana was sold at Mindleaf CBD.
“It is our contention that all of the items that were sold in Mindleaf were CBD, perfectly legal and were not marijuana, as defined by Pennsylvania law,” Asteak said.
“The THC level in the materials that were sold did not rise to the level that required the prosecutor to prove that they were marijuana,” he continued.
Items found in David Alloca’s residence included marijuana, THC products, psychedelic mushrooms, a handgun, shotgun and AR-15 rifle, according to the Northampton County District Attorney’s Office press release.
The Alloccas have been charged with possession with intent to deliver a controlled substance, conspiracy to deliver a controlled substance, drug paraphernalia, possession of drug paraphernalia, sale and possession of a controlled substance misbranded and misbranding a controlled substance.
Elizabeth Walter, a co-owner of Mindleaf before its closure, declined to comment.
